Wizarding Laws of Great Britain Wizarding Laws of Great Britain. Because of Security Concerns, continuing and escalating after the Dark Lord defeated Harry Potter and has since gained strength and support, the Ministry of Magic starting in 1998 passed even more laws designed to diminish the status of Muggleborns and Muggles in Wizarding Britain, things getting worse each year. It also sought to subject the population to its will and oppress any opposition that might come up.
Decree for the Immediate Reasonable Passage of Necessary Wizarding Laws in Times of Need and Emergency (2005) Times are dark, and dark times demand a need for security. When times turn as these have, it becomes necessary for one people to bring to power a party which will work to preserve the security of Wizarding Britain and of it's Wizarding citizenry. That is our aim: to work in the best interests of the Wizards and Witches of Great Britain.
Decree for the Formation of an Absolute Council of Heads of Departments (2006) A Council of Heads of Departments shall be assembled and composed of the heads of each department within the Ministry itself. The council will meet regularly, and may be called to assemble at the discretion of the Minister for Magic in times where it is necessary and the cause is just. It -- alongside the Minster for Magic -- will be given absolute power at its own discretion, and with the trust of the Wizarding people of Great Britain. The Council shall keep a journal of its proceedings, and from time to time publish the same, excepting such parts as may in their judgment require secrecy; and the yeas and nays of the members of the Council on any question shall, at the desire of three fifths of those present, be entered on the journal.
Guidelines of Powers of the Council of Heads of Departments (2007) The Council shall have power of taxation and regulation of moneys and related powers unlimited as it sees fit; To regulate activities with foreign nations as needed; To establish a uniform rule of Wizarding Citizenship; To provide for the punishment of illegal activities as it deems fitting; To establish owl post offices and post routes; To promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries; To constitute tribunals both inferior and superior to the Wizengamot; To declare war, grant letters of marque and reprisal, and make rules concerning captures on land and water; To raise and support agencies of law-enforcement and war-waging, but no appropriation of money to that use shall be for a longer term than approved by the Minister for Magic; To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel civil unrest; --And To make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this governing document in the government of Wizarding Britain, or in any department or officer thereof.
True Wizarding Minister for Magic Act (2009) The executive power shall be vested in a Minister for Magic of Wizarding Britain. He shall hold his office during the term of years subject to review by the Council of Department Heads, and, together with the the Council of Heads of Departments, shall oversee the general operations of the government. No person except a Wizarding Citizen of Great Britain, to have at least three grandparents of Magical blood, shall be eligible to the office of Minister for Magic; neither shall any person be eligible to that office who shall not have attained to the age of twenty-five years, and been so long a resident within the British Isles.
Decree for Expansion of Executive Powers of the Minister and Council (2009) In case of the removal of the Minister for Magic from office, or of his death, resignation, or inability to discharge the powers and duties of the said office, the same shall devolve on one elected by the Council of Heads of Departments from amongst themselves, or approved by said group. The Council may by law provide for the case of removal, death, resignation or inability of the Minister for Magic, declaring what officer shall then act as Minister for Magic, and such officer shall act accordingly, until the disability be removed, or a new Minister for Magic shall be elected. The Minister for Magic shall have power, by and with the advice and consent of the Council of Heads of Department, to make treaties, provided two thirds of the Council Members present concur; and he shall nominate, and by and with the advice and consent of the Council, shall appoint ambassadors, other public ministers and consuls, judges of the Wizengamot, and all other officers of the Ministry of Magic, whose appointments are not herein otherwise provided for, and which shall be established by law: but the Council may by law vest the appointment of such inferior officers, as they think proper, in the Minister for Magic alone, in the courts of law, or in the heads of departments. The Minister shall have power to fill up all vacancies that may happen during the recess of the Council, by granting commissions which shall expire at the end of their next session. He shall from time to time give to the Council information of the state of the union, and recommend to their consideration such measures as he shall judge necessary and expedient; he may, on extraordinary occasions, convene the Council, and in case of disagreement between them, with respect to the time of adjournment, he may adjourn them to such time as he shall think proper; he shall receive ambassadors and other public ministers; he shall take care that the laws be faithfully executed, and shall commission all the officers of Wizarding Britain.
Security Decrees (Formally Written Down 2005-2008) In the interest of maintaining national security a number of measures are being taken. Security Decree No. 1. Conversations. All conversations through telephone or by floo may be monitored in this interest. Security Decree No. 2. Floo Travel. Travels over the floo network may be monitored and/or traced. Security Decree No. 3. Apparition.Apparition may be monitored. Security Decree No. 4. Parties and Groups. All political parties must be approved by the government, and have current lists of active party members, with identification number, address, and telephone number all available. Their fireplaces must be configured for open access on the floo network. Security Decree No. 5. Curfew. No person, unless authorized specifically by the Ministry for Magic, is to be out between the hours of 10 PM and 5 AM, local time. Those caught out after hours without valid reason – latitude for determining whether reasons are valid or invalid will be given to the officers making note of the infraction – will be sent to the nearest center of Law Enforcement for appropriate processing. Repeat offenders will be imprisoned. Fines may be assessed, and greater punishments may be made as deemed appropriate. Security Decree No. 6. Registration. All Animagi must register with the Ministry. All Occlumens and Legilimens must also register with the Ministry. The additional teaching of these skills may not be conducted except under approval of the Dark Lord and the Council, and with supervision. All Metamorphagmi must also register with the Ministry. Muggles and Muggleborns must also register, as must those who are of mixed heritage, including, but not limited to: Dwarf, Goblin, Giant, etc. Failure to follow these rules may result in penalties at the discretion of the Department of Law Enforcement. Security Decree No. 7. Identification. All citizens are to carry their Ministry-issued identification cards, with picture, thumbprint, barcode, and all relevant information on it at all times. They may be asked to show it any any-time. Failure to do so will result in a fine and possibly jail time for repeat offenders. Each character's ID will denote Blood Status and any other pertinent information. Things like whether they are a metamorphmagi, animagi, werewolf, etc. will be denoted on the back of the card. This is for the security of citizens. Security Decree No. 8. Service Clause. Any person you might be requesting a service from has the right to refuse service to Muggle-Borns and Muggles. Security Decree No. 9Muggles. All persons lacking at least one magical grandparent are henceforth to be called Muggles. If found not to be carrying their Ministry-issued identification cards, with picture, thumbprint, barcode, and all relevant information on it, are subject to imprisonment or indentured servitude. This is for the security of citizens.
Squib Act (2010) Unions between Wizards or Witches and Muggles will be dissolved obligatorily if the marriage produces non-Magical offspring. Wizards or Witches choosing to remain in such unions can do so, at the cost of the Wizarding privileges and citizenship.
Guidelines for Operation of Wizengamot Under the Council (2011) The Wizengamot and Wizengamot Administration Services will oversee the Confederation of Magical Law, on which the Council of Heads of Departments will serve, along with select citizens of their choosing, coupled with that of the Minister for Magic, should the Council deem fit. The high court will be held in a dungeon, and the accused may be restrained as needed, while the Confederation of Magical Law hears the case, from a prosecutor and the defense. Courtrooms are located in the Ministry of Magic's tenth level, as tradition has set precedent.
Magical Education Act (2012) The Ministry revokes the privilege of Magical education to those lacking Magical ancestry. Any persons not having at least one Magical grandparent will not be allowed to attend Hogwarts School of Witchcraft and Wizardry, or any other Magical institute of learning. Those with education already underway are to be returned to their Muggle, non-Magical environment, and be assimilated into their own population, alongside other Muggles. The Ministry further reserves the right to limit or suspend the privilege of Magical education to certain individuals or groups as it sees fit.
Marriage Act (2013-2015) The marriage of Wizards to those lacking Magical ancestry is henceforth prohibited. Any previously existing unions will be recognized, if the Wizard/Witch in the union so wishes. If, however, the Wizard/Witch does not wish to recognize the union, they are free of any obligations tied to such, and the marriage will be effectively dissolved and annulled. Privilege Clause. Limited privileges over the Muggle populace will be given to those Muggles in already existing unions, which are not annulled by the wish of the Wizard/Witch involved. These privileges will be enhanced by the presence of Wizarding progeny. Custody Clause. The custody of any children produced by marriages to be dissolved will be left to the discretion of the Witch/Wizard involved. They are free to either keep the children and raise them as they see fit, or leave the children with the Muggle (Muggleborn) parent. Leaving the children with the parent lacking Magical ancestry does not constitute any financial responsibility, or other responsibility, on the part of the Witch/Wizard involved; in these cases, the non-Magical parent assumes all financial and other responsibility associated with the child. Both lose all association with the Witch/Wizard. Children left with non-Magical parents lose their privileges as Wizards/Witches, but this may be appealed by the Magical parent, and exceptions may be granted by a special committee of the Ministry.
